Anti-corruption Principles
When undertaking activities on behalf of Grow Asia, company members, board directors, consultants, service providers, and staff (the “Representatives”) shall:
-
respect and comply with applicable Anti-Corruption laws;
-
adopt a zero tolerance approach to all forms of bribery and corruption;
-
not instigate or participate in any form of conduct which may constitute a breach of the anti-bribery laws. Examples of such laws and regulations which may or may not be applicable to a Member include the US Foreign Corrupt Practices Act 1977, the UK Bribery Act 2010, the Singapore Prevention of Corruption Act (PCA) (noting the broader international framework including the United Nations Convention against Corruption and the OECD Convention on Combating Bribery of Foreign Public Officials in International Business Transactions. etc.), and Article 210 to 212 of the Revised Penal Code, Section 3 of RA No 3019, and Sec 7 (d) in relation to Sec 11 of RA No. 6713. In particular, no Representative shall directly or indirectly offer, promise, give, accept or solicit any advantage (e.g. money, goods, services or anything of value), to/from any public official or third party, as an inducement for action, or omission, for a corrupt purpose in connection with the Grow Asia partnership. Prohibited conduct also includes any illegal inducement or reward directly or indirectly offered, promised or provided in connection with the Grow Asia partnership in order to gain any commercial, contractual, regulatory, personal or other advantage;
-
not make facilitation or ‘grease’ payments (e.g. small improper payments for non- discretionary acts by public officials)
-
record and maintain full, accurate, and detailed financial accounts in their books and records, so that it is always clear to what payments relate to.
The Grow Asia Partnership will ensure that:
-
Grow Asia Philippines’ Anti-Corruption Principles are communicated on the PPSA website;
-
these Anti-Corruption Principles are referenced in all service and consultancy contracts that are procured and funded by the Grow Asia Philippines Inc; and
-
steps will be taken to mitigate the risk of corruption, if required, including undertaking due diligence on third parties and/or including anti-corruption contractual provisions in any agreement entered in to with the Grow Asia Philippines Inc.
